Privacy Policy

HYP Pty Ltd (“HYP”) takes your privacy seriously. We aim to be transparent about our data practices and provide users with controls over the data we store. This Privacy Policy explains the methods by which we collect information on users (“users” or “you”) from mobile applications and websites that provide us information, including visitors to our website(s), what information we collect, how that information may be used and shared, and what options users have regarding the collection and sharing of their data.

Background

We provide business analytics and intelligence solutions to our clients and partners, defined as our Services, which include working with advertisers, data partners, publishers and third-party ad exchanges across a network of mobile applications (“Apps”) and websites (“Sites”). We provide advertising targeting and analytics tools to advertisers and publishers. We use our proprietary technology and information collected from users to develop research and insight reports we then provide to businesses to help inform their business activities. This is primarily done using mobile location data with other supporting data points. 

Information collection

We collect (“Information”) from third-party data partners such as mobile application and website developers/publishers. This information is collected by using Application-Programming-Interfaces (APIs) or Software-Development-Kits (SDKs), both are technical methods by which these partners can provide us with information about their users. The following information is collected from mobile apps or websites

  • Mobile ad identifiers, primarily Apple iOS IDFAs or Google Android IDs, for mobile apps;

  • 1st party cookies for websites;

  • The precise geographic location of a device at a certain time, usually expressed in latitude/longitude coordinates along with a timestamp if a User has provided consent from the relevant App and enabled the mobile device to share location information. If you have previously given consent for collection of geolocation information, You are always free to turn off geolocation (or limit it to certain mobile applications) or to adjust your advertising settings on your device;

  • The horizontal accuracy of the latitude/longitude coordinates. If you have previously given consent for collection of geolocation information, You are always free to turn off geolocation (or limit it to certain mobile applications) or to adjust your advertising settings on your device;

  • Phone carrier and connection type (e.g., cellular, wifi);

  • Information about a device such as device type and model and OS type and version;

  • Device language;

  • Public facing (external) IP address of device;

  • Available or connected wifi SSID and/or BSSID names;

  • Altitude and vertical accuracy;

  • Bluetooth connected/available devices;

  • Beacon proximity or any beacon metadata.

Without limiting the above, we do not collect information that directly identifies a natural person, including the following information, among other information: names, email addresses, governmental IDs, drivers licenses, mobile phone or home phone numbers, login passwords.

Information use and sharing

The Information collected by HYP is aggregated from mobile app and website partners, specifically our data partners. It is then anonymised for the purposes of consumer safety and protection.  Then we make this information available to our customers securely via our proprietary platforms. The organisations, businesses and companies that purchase products from HYP then use this information to understand consumer trends across a variety of applications. These include, advertising targeting (inferred audience targeting, aggregated store visitation advertising attribution and cross device matching/targeting), consumer research (aggregate movement of consumers throughout a location), retail/place-of-interest analysis and evaluation (consumer retail shopping trends).

Information will also be used for HYP’s ability to provide and maintain the services we offer, internal operational purposes, for example, to make product and service improvement, quality & assurance checks, and for our own sales and marketing initiatives. We may also use and share Information for legal and accounting purposes, for example, (i) compliance and cooperation in good faith with governmental organisations including law enforcement, (ii) maintain and protect the rights of HYP and other, (iii) enhance and evaluate security and quality of Information and investigate potential misuse.

Opt-out of online advertising and information collection

Here is how to avoid information collection of your device and its associated location data used for HYP’s services and online advertising:

For iOS

  • go to “Settings” from your device’s home screen

  • scroll down to “Privacy”

  • select “Advertising”

  • and turn on “Limit Ad Tracking.”

For Android

  • go to “Google Settings” on your Device

  • select “Ads”

  • and check or toggle the setting labelled “Opt Out of Interest-Based Ads” or “Opt Out of Ads Personalisation.”

Location Services use can be managed at an individual app level across both operating systems.

Please note that these instructions may differ between devices and operating system versions.

My data/information collection opt-out

Opt-out and delete your information processed by HYP by following the instructions on our Device Opt-Out. Please note that we will need your Mobile Ad ID in order to identify your device in our systems.

Information collected when you visit our website

HYP may collect information from you when you visit our website, for the purposes of expressing interest in our services and contacting us. Any information you send to us such as your name, email address and phone number may be used to market our products and services to you, for example contacting you about your query, or sending you information about new products and services.

When you visit our website HYP or third-party platforms with which we work may automatically collect information from your browser, desktop, computer, laptop and or mobile device, classified as “Site Data”. This information may include a pseudonymised browsing identifier, IP address, network information, device/browser information, activity on our website and data about the other webpages you visit, the associated date and time including web log data.

This Site Data is used for analytics, marketing, research and website and services improvement. This Site Data may be correlated with a logged in user’s name and email address.

Our Use of Cookies. We (or other companies we work with) may collect or associate Site Data using “cookies.” Cookies are small data files that have unique identifiers and reside, among other places, on your Devices, in emails we send to you, and on the web pages of the HYP website. Among other things, cookies help us improve and personalise your use of the HYP website. We may permit certain third parties to place cookies through the HYP website to provide us with better insights into the use of the HYP website and user demographics and to provide relevant advertising to you. These third parties may collect information about your online activities over time and across different websites when you use the HYP website. For example, we utilise Google Analytics to analyse usage patterns for the HYP website. Google Analytics generates a cookie to capture information about your use of the HYP website that Google uses to compile reports on website activity for us and to provide other related services. Google may use a portion of your IP address to identify its cookie and for its commercial purposes.

Our Use of Web Beacons. Web beacons are electronic images that may be used on the HYP website or in emails we send to you. We use web beacons to deliver cookies, count visits, understand usage and effectiveness of offers, and tell whether you open an email and act upon it.


By accessing or using the HYP website, you consent to the placement of cookies on your browsers and devices and the use of web beacons as described in this Privacy Policy. You may block, delete, or disable cookies or web beacons to the extent permitted by your browsers, applications, and Devices as described in more detail below. However, if you do so, the performance of certain features of the HYP website may be limited or not to work at all.

Children's Privacy

Information Security

All of the User Information is kept on servers that HYP manages, using reasonable administrative, technical and physical safeguards designed to protect against unauthorised access or disclosure of data.   Please be aware that no data transmission over the Internet or information contained in our servers can be guaranteed to be 100% secure. As a result, while we strive to use commercially acceptable means to protect information, we cannot guarantee or warrant its security.

 

Information Retention

Information we collect is retained indefinitely provided that we will comply with the opt-out procedures described in Section 3 above, and will likewise comply with our representations in Section 10 regarding Information collected from devices located in EEA countries (and Switzerland).

Governance

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia applicable to agreements made and performed in Australia, excluding the application of the conflict of law provisions. You agree that any action or suit brought by a party to enforce or adjudicate your rights under this Agreement shall be brought in the federal or state courts located in New South Wales, Australia. This Privacy Policy is subject to our Terms of Service.
